1. Services

  1. By using the Medcast site (Services), you agree to be bound by these Terms of Use.

  2. You must use the Services for lawful purposes and in a way which does not infringe the rights of any third party or restrict or inhibit anyone's use of the Services.

  3. We do not represent or warrant that the operation of the Services will be secure, confidential, uninterrupted, error-free, accurate, complete or current.

  4. We may at any time and without notice, modify, suspend or terminate the operation of, or access to the Services, or any part of, for any reason, to interrupt the operation of the Services, or any part of, as necessary to perform maintenance, error correction or other changes.

2. Account

  1. Through our Services, you may log in to your Medcast account. You must comply with all relevant terms governing access to your Medcast account.

3. Privacy

  1. By using our services, we may have access to your personal information. The way in which we collect, store, use and disclose personal information is governed by our privacy policy, which is incorporated into these Terms of Use. The latest version of our privacy policy is available here.

4. Acceptable use

  1. You must not:

    1. copy, modify, or create derivative works based on the content available through the Services;

    2. infringe our intellectual property rights, privacy or confidentiality or that of any third party;

    3. engage in any activity that may result in injury, death, property damage, and/or liability of any kind;

    4. post or transmit any unauthorised material, including material that is (in our opinion) offensive, inflammatory, defamatory, racist, obscene or threatening; and

    5. attempt to destabilise, interrupt or overload our infrastructure by placing unreasonable burdens on our resources, including by sending requests to our systems more rapidly than could be achieved by a human user.

  2. You must not:

    1. use, or authorise to be used, automated means, including spiders, robots, crawlers, data mining tools, or similar, to download or scrape data or content from our website (or from other platforms via which we give you access to our data and content) for any purpose;

    2. submit, or authorise to be submitted, any data or content from our website (or data or content we otherwise give you access to) to any large language models or other machine learning or artificial intelligence platforms, tools, programs, software, operation, and/or similar (AI Programs); and/or

    3. use, or authorise to be used, any data or content from our website (or data or content we otherwise give you access to) for any purpose in relation to any AI Programs, including to create, develop, train, and/or otherwise improve any AI Programs and/or for the purposes of generating replicated or derivative content from such AI Programs.

5. Intellectual property rights

  1. We own, or are the licensee of, the intellectual property rights in the content available on our website and/or through the Services, including text, graphics, photographs, logos, icons, sound recordings and software. These Terms of Use do not transfer any intellectual property rights from us to you or any third parties.

  2. You must not (without our consent):

    1. adapt, reproduce, store, distribute, print, display, download, share with third parties, perform, publish or create derivative works from any part of the content or material made available to you through the Services;

    2. use our name, logo, graphics, and logos which appear on our website; or

    3. do anything which would infringe the intellectual property rights of us or any third party.

6. Linked websites

  1. The Services may contain links to third party websites, products, and services.

  2. We do not make any representations or warranties in relation to, and we exclude all liability from, third party websites, products and services.

7. Reliance

  1. To the extent permitted by law, we make no representations, and provide no warranties of any kind, including:

    1. that your use of the Services will be uninterrupted or error-free, free from loss, corruption, attack, viruses, interference, hacking, or other security intrusion; or

    2. that any information or other content posted or otherwise made available to you (including at an Event) by us or by third parties through the Services is complete, accurate, verified, audited, adequate, reliable, up-to-date, or suitable for any particular purpose, or that reasonable care has been taken in compiling, preparing and posting such information and third-party content.

8. Liability

  1. Your use of the Services is entirely at your own risk. None of the information and/or materials made available to you through the Services, or otherwise by us, is in the nature of advice. Information and/or materials provided through the Services is general in nature and subject to change and we have no obligation to verify and/or update such information or materials.

  2. To the extent permitted by law:

    1. the Services and all third-party content available to you through the Services are (except as expressly stated by us) provided "as is" and "as available" for your use without warranties of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement; and

    2. we are not liable for any direct, indirect loss or Consequential Loss resulting from:

      1. any action taken, or reliance made by you on any information or other third-party content available to you through the Services;

      2. any unauthorised access of or breach of security to the Services for whatever reason;

      3. any error, faults, omissions, inaccuracies or misrepresentation in relation to the Services and their content;

      4. the transmission of any virus; and/or

      5. your use of the Services.

  3. Nothing contained in these Terms of Use restricts or modifies any guarantee, right or remedy which pursuant to the Australian Consumer Law applies to these Terms or is conferred on you.

  4. To the extent that the Australian Consumer Law permits, Medcast's liability for its failure to comply with a guarantee imposed by the Australian Consumer Law in relation to the Services is limited to, as determined by us:

    1. the supplying of the services again; or

    2. the payment of the cost of having the services supplied again.

  5. In this clause 8:

    1. Consequential Loss includes losses which do not arise naturally from a breach of contract in the usual course, loss of profits, loss of revenue, loss of data, lost production, loss of business, loss of the benefit of any contract or other agreement or arrangement, death or personal injury, damage to health, damage to reputation, and legal costs; and

    2. Australian Consumer Law means the provisions of Schedule 2 to the Competition and Consumer Act 2010 (Cth), as applied under Part XI or under a law of a State or Territory.

9. General

  1. We may vary these Terms of Use from time to time and we will publish the varied terms on the Medcast site. Your continued use of the Services following any changes indicates your acceptance of the changes. The date listed at the beginning of this page indicates when these Terms of Use were last updated.

  2. Any failure by us at any time to enforce these Terms of Use or any rights will not be a waiver of such rights, or affect the validity of, these Terms of Use.

  3. If any provision of these Terms of Use is held by a court to be illegal, invalid or unenforceable under the applicable law, that term or provision will be severed from these Terms of Use and the remaining terms and conditions will be unaffected.

  4. These Terms of Use are governed by, and construed in accordance with the laws of New South Wales, Australia and the courts of the jurisdiction will have exclusive jurisdiction over any dispute arising out of these Terms of Use.
